COVID 19 Update: Due to the COVID 19 pandemic, Embassies have ceased most visa operations. This is drastically affecting the H2A visa program. To address the urgent need for workers in the U.S., it is expected that the Department of State will soon waive the interview requirement for H2A workers whose visas have expired within the last 12 months. However, the cessation of operations will not last indefinitely and the U.S. government is keenly aware of the importance of the H2A program to the American agriculture industry. IWA is continuing to assist its clients to process the steps of their paperwork and to line up prospective workers so that once operations come back on line, we are ready to deliver the workers to your site.

Legislative Update: In 2019, Congress introduced a bill known as the Farm Worker Modernization Act. If enacted, it would streamline the administrative processes of the H2A program and provide a path to citizenship for H2A visa holders. The bill can be found here:

How does it work?

IWA facilitates the following administrative steps for you so that you can secure H2A visas.

Step 1

IWA will assist the employer to file a work order with the relevant state workforce agency and advertise for American workers.

Step 2

IWA helps facilitate the temporary labor certification application to the U.S. Department of Labor (DOL). Our team will help demonstrate that the work is seasonal, that there are no American workers to fill the job and that hiring foreign workers will not adversely affect the local labor force.

Step 3

IWA will help the employer to request visas from USCIS. Our team will help the employer identify the prospective workers and provide the certification from DOL.

Step 4

Prospective workers outside the United States apply for visa and/or admission. Prospective workers listed in your USCIS paperwork must apply for an H-2A visa with the U.S. Department of State (DOS) at a U.S Embassy or Consulate abroad and then seek admission to the U.S. at a U.S port of entry.
