About the H-2A Program
H-2A classification may be extended for qualifying employment in increments of up to 1 year each. The maximum period of stay in H-2A classification is 3 years, at which time the worker must depart and remain outside the United States for an uninterrupted period of 3 months before seeking readmission as an H-2A nonimmigrant.
What is expected of employers?
Pay all government application fees; Pay for transportation to the worksite from the home country and back at the end of work
Provide housing and meal allowance; Pay Worker’s Compensation insurance; Pay the prevailing wage; Provide all necessary tools and training to do the job; Provide workers a basic contract
